General Terms of Business

1. Scope and Applicability

  1. These general terms of business (the "Terms") shall govern the contractual relationship between Botajon (the operator of botajon.com, hereinafter the "Site") and individuals using the Site (hereinafter "Customers").

  2. The Site allows Customers to discover travel inspiration through creator videos and directly book curated hotel accommodations and related travel services.

2. Definitions

In these Terms:

  • "Booking" means a confirmed reservation for a hotel or travel service made by the Customer through the Site.

  • "Botajon" means the operator of this Site.

  • "Hotel Provider" means the specific accommodation or property where the Customer will stay.

  • "Payment Partner" means third-party global distribution systems (e.g., LiteAPI) or suppliers that facilitate the Booking and process the payment on behalf of the Hotel Provider.

  • "Site" means the website botajon.com.

3. Platform Services, Content, and Curation

  1. Botajon provides a curated booking engine displaying hotels with an aggregate rating. While we strive to maintain strict quality standards, hotel conditions can change rapidly. Botajon acts as an intermediary and makes no absolute warranties regarding the real-time quality, safety, or physical condition of the property.

  2. Travel videos and influencer content featured on the Site are provided for inspiration only. They represent a specific moment in time. Botajon does not guarantee that a Customer's experience will exactly replicate the events, room types, or conditions shown in the creator's video.

4. Booking Process and Member Benefits

  1. Customers may create a free account to unlock exclusive member pricing and utilize promotional coupons. Coupons are subject to validation, cannot be combined with certain other offers, and may be limited to first-time bookings.

  2. When a Customer submits a Booking, they agree to provide accurate and complete information. The Booking is instantly processed through our Payment Partners and is subject to the specific cancellation, no-show, and refund policies of the chosen Hotel Provider, which are clearly presented at checkout.

5. Fees, Payment, and Third-Party Processors

  1. Payment Processing: When you make a Booking, the payment collection and processing are handled directly by our authorized Payment Partners or the Hotel Provider itself. Botajon does not collect, hold, or store your full credit card information.

  2. Bank Statements: Because payments are processed by our partners or the accommodations directly, the charge on your credit card or bank statement may appear under the name of the specific hotel, our Payment Partner, or a designated wholesale supplier, rather than "Botajon."

  3. Incidentals and Local Taxes: The Fees paid at checkout cover the room rate and standard taxes. Customers are solely responsible for any mandatory local city taxes, resort fees, or security deposits required by the Hotel Provider upon check-in.

6. Modifications, Cancellations, and Customer Support

  1. Tier 1 Support: Botajon provides primary customer support for Bookings made on the Site. However, our ability to modify or cancel a Booking is strictly governed by the Hotel Provider’s policies.

  2. Soft Modifications: Changes to the Lead Guest’s name, email, or special requests can typically be accommodated by our support team prior to check-in, subject to the Hotel Provider's acceptance.

  3. Hard Modifications (Cancel & Rebook): Because we offer live-market rates, modifying dates or room types directly is not supported. To change dates, the Customer must request a cancellation of the original Booking (subject to its specific refund policy) and create a new Booking. If a Booking is marked as "Non-Refundable" or is past the free cancellation window, Botajon cannot issue a refund or mandate a date change.

7. Botajon Care and AI Features

  1. Features such as "Botajon Care," live disruption alerts, and AI Chatbot assistants are provided for informational convenience only.

  2. While we attempt to provide accurate real-time data regarding weather, transport strikes, or local events, Botajon shall not be held liable for any inaccuracies, AI generation errors ("hallucinations"), or travel disruptions that are not detected by our systems.

8. Exclusion of Warranties and Liability

  1. Intermediary Role: BOTAJON ACTS SOLELY AS AN INTERMEDIARY. WE MAKE NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE ACTUAL SERVICES PROVIDED BY THE HOTEL PROVIDER. ISSUES REGARDING THE PHYSICAL EXPERIENCE (E.G., CLEANLINESS, AMENITIES, SERVICE) MUST BE ADDRESSED DIRECTLY WITH THE HOTEL MANAGEMENT DURING THE STAY.

  2. Liability Cap: BOTAJON HEREBY EXCLUDES ANY LIABILITY FOR DAMAGES, INJURIES, OR LOSSES EXPERIENCED DURING THE TRIP TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Various Provisions

9.1 Severability

Each provision of these Terms shall be interpreted in such a manner as to be effective and valid under applicable law. The invalidity or unenforceability of any provision of these Terms shall in no way affect the validity or enforceability of any other provision hereof. If any provision of these Terms is determined to be invalid, illegal or unenforceable, the remaining provisions of these Terms remain in full force and effect if both the economic and legal substance of the transactions that are contemplated in these Terms are not affected in any manner adverse to any Party.

9.2 No waiver

The waiver of a breach of these Terms or the failure of a Party to exercise any right under these Terms shall in no event constitute a waiver as to any other breach, whether similar or dissimilar in nature, or prevent the exercise of any right under these Terms. The failure of either Party to enforce at any time any of the provisions of these Terms, shall in no way be construed to be a present or future waiver of such provisions, nor in any way affect the ability of a Party to enforce each and every such provision thereafter.

9.3 Amendments

Botajon reserves the right to modify, suspend, or terminate the Site or any part thereof at any time without prior notice or liability. Botajon also reserves the right to change or update these Terms at any time by posting the revised Terms on the Site. Continued use of the Site after any such changes constitutes the Customer's acceptance of the new Terms.

10. Applicable Law and Venue

  1. These Terms shall be exclusively governed by substantial Swiss law under the exclusion of its conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

  2. The ordinary courts of the City of Zurich, Switzerland (Zurich 1) shall have exclusive jurisdiction with respect to any and all disputes arising out of or in connection with these Terms.
